1. Accepting the Terms of Use

The document detailed hereafter and other documents referenced therein comprise V-Bazaar’s Terms of Use. The word “Terms” will be used in reference to these for short.

These Terms of Use are legally binding between the user and V-Bazaar and strict adherence to them is expected at all times.

Please be advised that Section 11, entitled Resolving Disputes with V-Bazaar, contains an arbitration clause and class action waiver. By accepting the Terms of Use, the user acknowledges that any and all disputes with V-Bazaar as a company will be resolved through binding individual arbitration, and that any and all rights to have the aforesaid disputes decided by a judge or jury are thereby waived. The user’s right to participate in class actions, class arbitrations, or representative actions are also hereinafter waived by agreeing to the Terms.

The user’s rights and responsibilities when using V-Bazaar as a retail platform, whether as a customer or a vendor, are detailed in this contract. The user is advised to pay due and careful attention in reading it. By using V-Bazaar in any way, the user is acknowledging and agreeing to the Terms of Use.

The user is advised that, if they do not agree with the Terms, their use of V-Bazaar is prohibited.

2. Further Documentation, Rules and Policies

V-Bazaar is designed to connect people worldwide with a common passion. That is, a love of all living creatures, the environment and the planet. Here, these people can buy and sell goods that are vegan-friendly, environmentally protective, cruelty-free and globally conscious. Specific rules are relevant to different users, depending on whether the user is a customer or a vendor, which we have outlined below:

Terms of Use for All Users – the user agrees to these Terms, as well as our Privacy- and Anti-Discrimination Policies, upon using V-Bazaar.

Customers’ Terms of Use – applicable to customers on V-Bazaar who are looking to browse and buy products from our vendors. These Terms can be viewed by clicking this link.

Vendors’ Terms of Use – applicable to vendors who intend to use V-Bazaar as a retail platform for selling their products and merchandise. These Terms can be viewed by clicking this link.

Third Party Terms of Use – applicable to the following types of user:

  • Owners of any intellectual property submitted to V-Bazaar.
  • Anyone requesting information from V-Bazaar.

All of the above-listed Terms and Policies all comprise V-Bazaar’s full Terms of Use. Users are advised to read the Terms and Policies that are relevant and applicable to them and that they are solely responsible for doing so.

The rest of this document comprises the Terms of Use for All Users.

3. User Privacy

V-Bazaar respects that our users’ personal information is important and therefore we consider it equally important to protect that information. The company has its own Privacy Policy, wherein it is detailed how customers’ and vendors’ personal information is used when they use V-Bazaar. By using V-Bazaar, the user is agreeing and acknowledging that the company can process their information in accordance with the aforementioned Privacy Policy. The user is advised to read the policy (click here).

V-Bazaar and the vendors who use it as a retail platform will process customers’ personal information (e.g. name, billing and shipping address and email details). Under this, V-Bazaar and vendors are considered separate and independent parties as data controllers of the customers’ personal information under EU law. As such, each party is responsible for the personal information it processes in providing their respective services. That is, if a vendor accidentally breaches data privacy regulations, e.g. disclosing a customer’s name and email address when processing an unrelated order, the legal responsibility for this breach falls to the vendor, not V-Bazaar. 

Users are advised that scenarios do exist in which V-Bazaar and vendors act as joint data controllers of customers’ personal information. In the event that this is the case and legal action is taken against V-Bazaar, including a plaintiff bringing suit, V-Bazaar being fined, or the company otherwise incurs expenses because of something that a vendor did as a joint data controller of customer personal information, the vendor agrees to indemnify V-Bazaar for the expenses it occurs in connection with the vendor’s processing of customer personal information. See Section 9. entitled Legal Action & Indemnification for further information about user indemnification obligations to V-Bazaar.

4. Holding an Account with V-Bazaar

Users are required to create an account with V-Bazaar to make use of the company’s services and platform. In creating a V-Bazaar account, users will adhere to the following conditions:

  1. The user must be 18 years or older to sign up for a V-Bazaar account. Users under 18 but who are at least 13 years of age, herein termed Minors, are permitted to use V-Bazaar by way of a parent or legal guardian who is a V-Bazaar account holder, assuming appropriate permission and supervision is given. Children under 13 years are not permitted to use V-Bazaar under any circumstances. Responsibility falls to the user who is the named account holder for any and all activity conducted by a Minor on their account. V-Bazaar advises users who have permitted a Minor to use their account to read the Minors Policy, which can be found here.
  • The user will provide honest and accurate information about themselves. V-Bazaar takes a strong stance against falsified information, impersonation and identity fraud by way of a V-Bazaar account.
  • The user will represent themselves appropriately. Users may decide not to use their full name in association with their V-Bazaar account. However, V-Bazaar prohibits the use of offensive or vulgar language, nor language that is in violation of V-Bazaar’s Anti-Discrimination Policy, Intellectual Property Policy, or the overall Terms of Use.
  • The user accepts full responsibility for their V-Bazaar account, their password and any and all activity conducted thereon. Sharing an account with other users is permitted, but in these cases, responsibility for the account and activity thereon falls to the user whose billing information is associated with that account. If the user is registering on V-Bazaar in a business capacity, the user submits to personally guarantee that they hold the appropriate and necessary authority to agree to V-Bazaar’s Terms of Use on the business’ behalf. Users are advised that accounts are not transferable under any circumstances.
  • The user acknowledges that registering an account with V-Bazaar does not forge any corporate relationship with the company, e.g. a relationship that can be construed as a partnership, joint venture, employment, or franchise ownership.

5. User Content

The user submits and acknowledges that content they post using V-Bazaar is their property. V-Bazaar does not claim ownership over any content the user uploads. This includes usernames, profile pictures, shop names, product listings including photos and descriptions, product reviews, comments and videos.

  1. The user understands and submits sole responsibility for content they upload to V-Bazaar. They are aware that they have all necessary rights to this content and that, in uploading or posting it to V-Bazaar, they submit that they are not infringing or violating any third party’s rights.
  • In uploading or posting content to V-Bazaar, the user submits that V-Bazaar has a license to use the content. The company does not claim any ownership to any user’s content, but in uploading the content, the user automatically grants V-Bazaar permission to use it in order to help V-Bazaar prosper as a business. In doing so, V-Bazaar does not infringe any rights held by the user by way of their content, and this enables V-Bazaar to promote the content as appropriate or necessary.

By extension, the user submits that, in posting content to V-Bazaar, they grant the company a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of users’ content. This enables V-Bazaar to maintain itself as a retail platform and to promote the company, the vendors, and their shops in any formats and through any channels, including across V-Bazaar’s website, third-party websites or advertising media. Examples include:

  • If the vendor uploads a photo of a product, they submit that V-Bazaar has permission to display it to customers and that V-Bazaar can alter the image (e.g. resize) for the benefit of mobile users.
  • If the vendor uploads a photo of especially good quality, they submit that V-Bazaar may use this on the website’s homepage, in digital marketing campaigns such as our blog, customer emails or social media accounts so as to promote both V-Bazaar and the vendor’s product.
  • If the vendor has written a product description in English, they submit that V-Bazaar may translate this text to be understood by international customers.

In agreeing to the Terms of Use, the user submits that they will not to assert any moral or publicity rights against V-Bazaar for using any content for the aforesaid purposes in the aforesaid ways.

Furthermore, the user recognises and acknowledges V-Bazaar’s legitimate interest in using user content, and that V-Bazaar agrees not to infringe upon the license granted by the user in registering their account.

  • V-Bazaar is committed to upholding respect for the intellectual property rights of its users and vendors. In carrying out its services as a retail platform, V-Bazaar commits itself to adhering to the appropriate legal procedures relating to infringement of those intellectual property rights.

If the user’s content has been used on V-Bazaar’s domain without the user’s permission and the user wants the content in question removed, the user is advised to follow the instructions outlined in V-Bazaar’s Intellectual Property Policy.

If the user’s content is alleged to infringe the intellectual property rights of another user, V-Bazaar will act accordingly and consistently with the severity of the infringement. That could range from the offending account’s disablement – providing V-Bazaar is given due, proper notice – to full termination of the offending user’s account – this will happen if multiple counts of infringement are found. V-Bazaar reserves the right to take the aforesaid action, however users are advised that they will be notified if their account is disabled or terminated and the reasons why.

  • The user agrees that content will not contain language that can be construed or defined as abusive, threatening, defamatory, obscene, vulgar, or otherwise in violation of V-Bazaar’s policies for Prohibited Items, Community Standards, Anti-Discrimination, or, by extension, any part of the overall Terms of Use.

The user further submits that content they post will not be false or misleading in nature, particularly for interfering or malicious purposes, nor of a nature that is found to be fraudulent or deceptive.

6. Using V-Bazaar’s Platform

In registering an account with V-Bazaar, the company grants the user a limited, non-exclusive, non-transferable, and revocable license to use its retail platform and domain. This license is subject to the Terms of Use, particularly citing the following conditions and restrictions:

  1. The user agrees that they will not breach or violate any laws in connection with using V-Bazaar. This includes any local, national, and international laws that may apply to the user. Examples include but are not limited to the following:
    1. The responsibility falls to the user to acquire the necessary permits, permissions or licenses that their shop requires.
    1. A vendor may not sell anything on V-Bazaar that breaches or violates any local, national and international laws.
    1. The user submits compliance with V-Bazaar’s Sanctions Policy
    1. The user submits they may not engage in activity or behaviour that could be recognised or construed as fraudulent or theft towards or against V-Bazaar as a company, another user of the platform, or a third party.
    1. The user submits they may not show conduct that could be recognised or construed as anti-competitive or threatening towards V-Bazaar as a company, another user of the platform, or a third party.
  • The user acknowledges that they are solely responsible for paying all fees incurred during use of or owed to V-Bazaar. Except as set forth below, the user also submits sole responsibility for collecting and/or paying any applicable taxes for any purchases or sales the user makes through V-Bazaar’s platform. For digital items sold to customers in Australia, Belarus, the EU, Iceland, India, New Zealand, Norway, Russia, Serbia, South Africa, South Korea, Switzerland, Taiwan, Turkey or United Arab Emirates, V-Bazaar will help collect and remit the correct amount of VAT (while some countries may refer to VAT using other terms, e.g. GST, VAT is herein used as a collective umbrella term for GST and any other local sales taxes). In addition, for items shipped to Washington State or Pennsylvania (or, for digital items, those purchased with a Washington State or Pennsylvania billing address), V-Bazaar will calculate, collect and remit the applicable sales tax. Fees, bills and taxes applicable to the user, and details as to how the user can pay them are fully outlined in V-Bazaar’s Vendor Fees & Payments Policy.
  • The user agrees not to “crawl,” “scrape,” or “spider” any page on V-Bazaar’s platform or to reverse engineer or attempt to obtain the source code of the platform or domain.
  • The user agrees not to interfere with or try to disrupt services conducted on V-Bazaar’s platform, e.g. distributing malicious or harmful computer code or software.
  • The names “V-Bazaar” and the other V-Bazaar marks, phrases, logos, and designs used by the company in both direct and indirect connection and association with the domain, platform and the services conducted thereon, are trademarks, service marks, or trade dress of V-Bazaar in the UK and other countries. If the user would like to use our trademarks, please refer to and follow our Trademark Policy.
  • V-Bazaar acknowledges all user suggestions, ideas and feedback in order to constantly improve the user experience and the platform. Unsolicited ideas, suggestions or materials the user submits to V-Bazaar (excluding the user’s content or items the user sells on the retail platform) are considered non-confidential and non-proprietary to the user. The user grants V-Bazaar a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to the user.
  • When appropriate and necessary, V-Bazaar will provide the user with certain legal information in writing. By using V-Bazaar’s platform, the user is agreeing to our Electronic Communications Policy. This describes how the company will provide that information to the user. The policy states that the company can send the user information electronically (e.g. by email) instead of post. The policy also states that the user’s electronic agreement is as binding as the user’s signature on paper.

7. Termination of a V-Bazaar Account

The user has the right to terminate their account with V-Bazaar at any time, by way of their account settings. Any content posted on the site prior to termination and the availability thereof will not be affected by that account’s termination. Any fees or bills outstanding at the time of termination will still require to be paid by the user.

V-Bazaar reserves the right to terminate or suspend an account (and any related accounts) as well as terminate or suspend a user’s access to the platform at any time, for any reason, and without prior notice. In the event of V-Bazaar terminating or suspending an account or access permissions, the user is advised that they do not have a contractual or legal right to continue to use V-Bazaar’s platform or the services conducted thereon, e.g. to sell or buy on the site. V-Bazaar reserves the right to refuse service to anyone, at any time, for any reason.

If the user or V-Bazaar terminates an account, the user may lose any information associated with that account, including content.

V-Bazaar reserves the right to change, suspend, or discontinue any of its services at any time, for any reason. The company will not be liable to the user for the effect that any changes to the platform may have on the user, including the user’s income or ability to generate revenue by way of the V-Bazaar platform.

V-Bazaar’s Terms of Use will remain in effect even after the user’s account and or access permissions for V-Bazaar have been terminated, or after the user stops using V-Bazaar’s platform.

8. Warranties and Limitation of Liability

The user submits that they understand that V-Bazaar does not manufacture, store, or inspect any of the items sold through across its platform. The products listed on the online marketplace are produced, listed, and sold directly by independent vendors. Therefore, V-Bazaar cannot and does not make any warranties or guarantees about their quality, safety, or legality. Any legal claim or suit in relation to a product or service purchased by the user must be brought directly against the vendor of the aforesaid product or service. The user thereby releases V-Bazaar from any legal claims or suits related to products sold across the platform, including but not limited to claims in relation to defective items, in relation to misrepresentations by vendors, or in relation to product liability, e.g. products that have caused physical injury to the purchaser or a third party.

The user acknowledges that, in using V-Bazaar, they may come across content and materials that they find offensive or inappropriate. V-Bazaar makes no representations concerning any content posted by users on the platform. V-Bazaar is not responsible for the accuracy, copyright compliance, legality, or decency of user content that the user has accessed on V-Bazaar’s site. The user thereby releases V-Bazaar from all liability relating to the offending content.

The user acknowledges that V-Bazaar does not screen or vet other users with whom they may communicate via tools on the website. The user thereby releases V-Bazaar from all liability relating to their interactions and communications with other users. The user is advised to exercise caution and good judgment in all interactions with other users, whether in electronic communications or in face-to-face interactions.

Some of the pages on V-Bazaar may contain links to third-party websites or services over which V-Bazaar claims no ownership or control, e.g. links to social media channels like Facebook, Twitter and Instagram. When the user accesses these third-party services, the user is advised that they do so at their own risk. V-Bazaar is not responsible for any activity conducted on third-party websites. The third parties may require the user to accept their own terms of use when accessing these sites. Users are advised that V-Bazaar is not a party to the aforesaid agreements; they are solely between the user and the third party.

The user acknowledges that V-Bazaar does not make any warranties or guarantees in relation to Gift Card balances and is not responsible for any unauthorised access to, or alteration, theft, or destruction of a Gift Card or Gift Card code that results from any action by the user or a third party.

The user further acknowledges that V-Bazaar may suspend or prohibit use of the user’s Gift Card if that Gift Card or Gift Card code has been reported lost or stolen, or if we believe the balance of that Gift Card is being used suspiciously, fraudulently, or in an otherwise unauthorised or illegal manner. If the user’s Gift Card code stops working, the user is advised to contact V-Bazaar, who can issue a replacement Gift Card code to the user.

In the event of a special offer or promotion, the user submits that they may not later claim that the rules of that special offer or promotion were unclear or ambiguous.

V-Bazaar is dedicated to making its site as good as possible and providing the best possible user experience. However, the user will hereby submit in agreeing to the Terms of Use to the understanding that V-Bazaar as a platform is provided “as is” and without any kind of express or implied warranty.

Therefore, V-Bazaar expressly disclaims any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.

V-Bazaar does not guarantee the following:

  • Its platform and domain will be secure or available at any particular time or location.
  • Any defects or errors will be corrected.
  • Its platform and domain will be free of viruses or other harmful materials and/or software.
  • The results of using V-Bazaar will be consistent with the user’s expectations. The user uses V-Bazaar solely at their own risk.

Please be advised that some jurisdictions do not allow limitations on implied warranties, so the limitations listed above may not be applicable to the user.

To the fullest extent permitted under the law, neither V-Bazaar, nor its directorial staff, nor its employees, shall be held liable to vendors for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in association with V-Bazaar’s retail platform or its Terms of Use herein detailed. Under no circumstances shall V-Bazaar’s aggregate liability for any damages exceed one hundred ($100) US Dollars or the amount the user paid V-Bazaar in the past twelve months.

Please be advised that some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not be applicable to the user.

9. Legal Action & Indemnification

In the unlikely event of legal action or suit being brought against V-Bazaar because of something that the user did, the user hereby agrees to defend and indemnify us. More specifically, the user submits that they will defend V-Bazaar (including any of its employees) and hold them harmless from any legal claim or demand (including reasonable lawyer’s fees) that arises from the user’s actions, the user’s use (or misuse) of V-Bazaar’s platform, the user’s breach of the Terms of Use, or the user’s account’s infringement of the rights of either another V-Bazaar user or a third party.

V-Bazaar reserves the right to conduct our legal defence in accordance with how the company sees fit, even if the offending user(s) indemnify V-Bazaar. In this case, the user hereby submits to cooperate with us so that V-Bazaar can execute its defence strategy.

10. Disputes with Other Users

If the user finds themselves in a dispute with another V-Bazaar user or a third party, the company encourages an amicable resolution to be attempted between the two parties.

Customers and vendors who are unable to resolve a dispute in relation to a transaction on V-Bazaar’s website may use the case system. By way of this case system, V-Bazaar will attempt to assist in the dispute’s resolution. All users and parties involved in such disputes will submit and acknowledge herein that resolutions conducted by V-Bazaar will be in good faith and based solely on the mediator(s)’ interpretation of the applicable policies. V-Bazaar will not make judgments regarding legal issues or claims. V-Bazaar has no legal obligation to resolve any disputes.

The user herein agrees to release V-Bazaar from any claims, demands, and damages arising out of disputes with other users or third parties.

11. Disputes with V-Bazaar

The users are within their rights to bring any dispute with V-Bazaar as a company to their attention. In response, V-Bazaar submits to attempt to resolve the issue in whatever way is seen fit and appropriate.

In the event that a resolution cannot be reached, below is detailed conditions and regulations that will govern any legal disputes in relation to V-Bazaar, its platform and domain.

  1. Governing Law

V-Bazaar’s Terms of Use are governed by the laws of the United Kingdom. These laws will apply no matter where in the world the user lives, but if the user lives outside of the United Kingdom, the user may be entitled to the protection of the mandatory consumer protection provisions of their local consumer protection law.

  • Arbitration

The user and V-Bazaar agree that any dispute or claim arising from or in relation to the Terms of Use shall be ultimately settled by final and binding arbitration, using the English language, administered by the London Court of International Arbitration (hereinafter known as the “LCIA”) in accordance with the Arbitration Act 1996, then in effect. Arbitration will be handled by a sole arbitrator in accordance with those rules. Judgement on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms of Use will take place on an individual basis – class arbitrations and class actions are not permitted.

The user submits to the understanding that, in agreeing to the Terms of Use, they and V-Bazaar are each waiving the right to trial by jury or to participate in a class action or class arbitration. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator. The user may instead assert their claim in Small Claims Court, but only if the user’s claim qualifies, the user’s claim remains in such court, and the user’s claim remains on an individual, non-representative, and non-class basis.

  • Costs of Arbitration

Payment for any and all reasonable LCIA filing, administrative, and arbitrator fees will be in accordance with the Arbitration Act 1996. If the value of the user’s claim does not exceed £10,000, V-Bazaar will pay for the reasonable filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator finds that either the substance of the user’s claim or the relief sought was frivolous or brought for an improper purpose.

  • Forum

V-Bazaar’s Head Office is based in Bournemouth, Dorset and therefore any legal action and proceedings against the company in relation to its platform, domain and services provided thereon must be filed and take place in Bournemouth. For all actions under the Arbitration Act 1996, the proceedings may be filed where the user’s residence is, or in Bournemouth, Dorset, and any in-person hearings will be conducted at a location which is reasonably convenient to both parties taking into account their ability to travel and other pertinent and/or extenuating circumstances. For any actions not subject to arbitration, the user and V-Bazaar agree to submit to the personal jurisdiction of a court located in

  • Government Exception

If the user is a government agent or entity in the United Kingdom using V-Bazaar’s platform and services conducted thereon in their official capacity, and the user is legally unable to agree to the clauses in this section, then those clauses do not apply to the user. In cases such as these, the Terms of Use and any action related to those terms will be governed by the laws of the United Kingdom (without reference to conflict of laws).

  • Modifications

If V-Bazaar make any changes to the section of its Terms of Use entitled “Disputes with V-Bazaar” after the date on which the user last accepted the Terms of Use, those changes will not be reflected in nor be applicable to any claims filed in a legal proceeding against V-Bazaar prior to the date the changes became effective. V-Bazaar submits that they must notify the user of substantive changes to the “Disputes with V-Bazaar” section at least 30 days prior to the changes’ effective date. If the user does not agree to the modified terms, the user may send V-Bazaar a written notification (either written or by email) or close their account within that 30-day period.

In the event that a modified term is rejected, or the user’s account is permanently closed, the user agrees to arbitrate any disputes between the user and V-Bazaar in accordance with the provisions of this “Disputes with V-Bazaar” section as of the date the user last accepted the Terms of Use. This includes any changes made prior to the user’s rejection. If the user reopens their closed account or creates a new account, the user agrees to be bound by the current version of the Terms of Use.

12. Changes to the Terms

V-Bazaar will update its Terms of Use on a regular basis. If it is believed that the changes in question are material, V-Bazaar submits that users must be informed and will aim to do so in one of the following ways:

  1. Detailing the changes in a public post on the website, such as a blog post.
  2. Sending all users an email or message detailing the changes therein.

The user is within their rights to decide whether or not they wish to continue using V-Bazaar. Any changes to the Terms of Use will be effective upon those changes being posted. Users are advised that they are solely responsible for reviewing and becoming familiar with any changes to the Terms of Use. The user’s use of V-Bazaar after the changes constitutes the user’s acceptance and understanding of the updated Terms.

13. Further Legal Points for the Users’ Attention

The Terms of Use detailed herein, as well as all of V-Bazaar’s policies that help comprise the overall Terms of Use, supersede any other agreement between the user and V-Bazaar regarding the platform, domain and services provided thereon. If any part of the Terms of Use is found to be unenforceable, the offending part will be limited to the minimum extent necessary in order that the Terms of Use will otherwise remain in full force and effect. Any failure on V-Bazaar’s part to enforce any part of the Terms of Use is not to be regarded as a waiver of the company’s right to later enforce that or any other part of those terms. V-Bazaar may assert any of its rights and obligations under the Terms of Use.

Please be advised that by using V-Bazaar, the user is agreeing to adhere to the following customers’ terms and conditions, which form part of our Terms of Use.

1. V-Bazaar’s Limitations as a Marketplace

As a venue, V-Bazaar provides a platform for its customers to purchase cruelty-free and globally conscious merchandise and products from vendors worldwide. Prospective customers are advised that V-Bazaar forms no part of the customer-vendor transaction. If the customer shops at V-Bazaar, they will understand the following:

  1. Purchases are not made directly from V-Bazaar. The vendors who use V-Bazaar as their platform administrate the purchases themselves. The customer understands that the vendors will have their own methods and timescales for processing and shipping. Customers will also understand vendors may have separate and differing policies to those upheld by V-Bazaar, and that it is their responsibility to understand and adhere to them.
  2. V-Bazaar does not vet vendors immediately prior to their selling on the platform. We cannot offer any guarantees as to the quality of the products or services offered by the vendors, nor can we endorse particular merchandise.
  3. It is the customer’s responsibility to report any product, comments, reviews, etc. believed to be in violation of V-Bazaar’s Anti-Discrimination and/or Prohibited Items Policies.

2. Intercommunication with Other V-Bazaar Users

V-Bazaar has a conversation tool, which enables users to communicate directly with one another, whether as a way of contacting vendors or other V-Bazaar customers. This tool comes in handy when customers have any questions about a product or an order they have placed. However, the tool may not be used for the following:

  • Spamming vendors or other V-Bazaar users.
  • Sending unsolicited promotional or advertising material.
  • Canvassing vendors or other V-Bazaar users for donations.
  • Communicating in a way that violates our Anti-Discrimination Policy.
  • Committing harassment towards another user, i.e. continuing to contact a user after they have explicitly asked the user not to
  • Interfering with the business of a vendor.

What is Interference?

When a user deliberately acts to drive away business from another vendor’s shop – this is known as interference. Such behaviour is strictly prohibited on V-Bazaar. Examples of acts of interference include:

  • Contacting other users via the communication tool to advise them against business with a particular vendor or from purchasing a particular item.
  • Committing click fraud. This is when a user clicks on a competitor’s Promoted Listings ads in order to drain their advertising budget.
  • Discussing a dispute with another V-Bazaar user or vendor in public areas.
  • Purchasing a vendor’s products to deliberately leave negative reviews.

Harassment

V-Bazaar strictly prohibits the use of its communication tools to harass other users or vendors. The communications tool may not be used to support or glorify hate groups or members thereof or violate the Anti-Discrimination Policy in any way. Receipt of any such messages or communication should be reported to V-Bazaar staff immediately.

3. Purchasing from V-Bazaar

Remember that vendors are using V-Bazaar as a platform to sell their own products and merchandise. Therefore, when the user purchase from a vendor’s shop on V-Bazaar, the user is directly supporting their individual, independent business. As such, each vendor will have their own product listings, timescales for processing and shipping orders and differing payment systems.

When the user makes a purchase on V-Bazaar, the customer is agreeing to the following:

  • That they have read and understood the product’s description and vendor’s shop policies prior to purchasing.
  • That they have paid the correct and appropriate for product(s) / service(s) purchased.
  • That they have provided correct and accurate shipping information including name, address and postcode to the vendor.

Furthermore, in agreeing to the above, the customer also agrees to comply with V-Bazaar’s Payments Policy.

When purchasing or redeeming gift cards and credit points, the customer agrees to comply with our Gift Cards & Credits Policy.

4. Leaving Product Reviews

By leaving a product review, the customer is assisting fellow V-Bazaar users. This can either be via recommendations to products they have enjoyed, to help build a good vendor’s reputation, or make potential customers aware of products and vendors with which the customer has had a bad experience.

Reviews can be posted with a star rating and a photograph up to 100 days after the product’s delivery date. If no estimated date for delivery is shown on the user’s account, customers will be able to post reviews after the product’s processing and/or shipping time has passed. Reviews can be edited within the 100-day period as many times as necessary – this also includes the photo. Customers are advised that their profile information will be publicly displayed alongside the review and photograph on the listing and review pages for that product’s vendor.

When posting a product review, the customer must adhere to the following:

  • The content must be based on the customer’s true experience of the product or service being reviewed.
  • The content cannot contain personal, private or confidential information.
  • The content must not consist of language or imagery that is considered obscene, racist, or can be construed as harassment.
  • The content must not contain any threatening or extortive language.
  • The content must not in any way be in violation of V-Bazaar’s Anti-Discrimination Policy.
  • The content must not contain any unsolicited advertising or promotional material.
  • The review must not contain any spam content.
  • The review must not relate to matters outside of the vendor’s control or responsibility, e.g. matters relating to the shipping carrier or courier, V-Bazaar itself, or a third party.
  • The review must not contain content that will falsely increase a vendor’s overall score.

When uploading a photograph to V-Bazaar, the customer acknowledges the following:

  • The ownership, rights and/or permission for the photograph being uploaded must belong to the customer.
  • In uploading the photograph, as detailed in V-Bazaar’s Terms of Use, V-Bazaar has the right to use and reuse any content uploaded.

If the customer leaves a product review of three stars or less, the vendor may respond. These responses must also adhere to the above conditions. Vendors do reserve the right to hide any photographic content that they consider an inaccurate representation of their merchandise or brand. Vendors also reserve the right to report any review content that they believe violates V-Bazaar’s Terms of Use and policies.

Further to this, V-Bazaar also reserves the right to remove content that we believe violates our Terms of Use and policies.

5. Creating and Uploading Content to V-Bazaar

V-Bazaar users are able to create and upload a variety of content to the site – text-based, photographic, and video. We aim to keep the V-Bazaar environment safe and expect our users to uphold the same standard. Therefore, in agreeing to the Terms of Use, users are acknowledging the following:

  • Content will not contain any language that can be considered abusive, extortive, threatening, harassment, or otherwise in violation of our Anti-Discrimination Policy.
  • Content will not contain any language considered defamatory or libellous in nature, or in any way designed to deceive or mislead fellow V-Bazaar users, other vendors or potential customers.
  • Content will not be obscene or vulgar in nature.
  • Content will not violate the privacy, copyright or intellectual property ownership of another V-Bazaar user, vendor or a third party.

6. Reporting a Problem with an Order or Returning an Item

V-Bazaar may not be directly involved in the customer-vendor transaction when it comes to orders, but we have a system to deal with purchases that have not gone according to plan. It’s unlikely, but it does happen. By using V-Bazaar’s system, the customer acknowledges that that V-Bazaar may use their personal information where applicable and necessary in order to resolve any issues with other members.

The customer can use V-Bazaar’s system to resolve issues directly with the vendor if a product has not been delivered or is incorrect / different to the product ordered.

Non-Delivery

V-Bazaar defines a non-delivery as a product that has been ordered but not received. The following scenarios are defined as cases of non-delivery under V-Bazaar’s system:

  • Proof that the product was shipped out to the customer cannot be supplied.
  • The product was not sent to the address provided by the customer on V-Bazaar.

Incorrect / Different Product

V-Bazaar defines a scenario wherein the product is incorrect or different to that which the customer ordered by the following:

  • The product has been received, but is a different colour, size or model to that which was ordered.
  • The product has been received but is different in design or material.
  • The product has been received but is damaged, faulty or incomplete, e.g. missing components.
  • The quantity of items received differs from the original order.
  • The quality or condition of the products received are different to the vendor’s stipulations.

Customers should be advised that the vendors’ product descriptions, listings and photos will be used to assess these scenarios as appropriate.

Late Delivery

The customer must provide evidence of all of the following conditions for V-Bazaar to resolve a Late Delivery issue:

  • The product(s) in question were ordered for a specified date or event.
  • The product(s) in question expired or were rendered useless after that date.
  • The vendor did not ship the product(s) in accordance with their stipulated timescales, or a date privately agreed with the customer via V-Bazaar’s communication tool.

If, following assessment, V-Bazaar determines that a product is incorrect or different to that originally ordered, the vendor will be required to send a refund to the customer. Vendors should be aware that the refund requires original shipping and return shipping costs be included therein.

Irresolvable Scenarios

There are some scenarios and issues that V-Bazaar cannot resolve. By agreeing to the Terms of Use, the customer acknowledges that V-Bazaar accepts no responsibility towards the following scenarios:

  • Products that are damaged by shipping carrier or third party courier. Vendors are advised to provide evidence that the product was packaged correctly and properly prior to shipping.
  • Products that have been received, then used, washed, altered or discarded thereafter.
  • Late delivery issues that arise because of shipping delays.
  • Issues relating to products / services that are prohibited from sale on V-Bazaar.
  • Issues relating to financial transactions made outside of V-Bazaar’s own payment processing system.
  • Issues relating to the cost of shipping.
  • Issues relating to in-person purchases.
  • Products that are returned despite the absence of a return agreement.
  • Products that adhere to the vendor’s description but don’t meet the customer’s expectations.

Requesting a Cancellation

A financial transaction can only be cancelled by a vendor. A customer can only cancel a transaction by contacting the vendor in question and request that they cancel it. This can be done using V-Bazaar’s communication tool.

Customers are advised that all cancellations must adhere to V-Bazaar’s Anti-Discrimination Policy.

Returning an Item

Customers are advised that return policies are unique to each vendor on V-Bazaar; some may not accept returns at all. The details for returns should be detailed on that vendor’s shop page. The customer is advised that it is there responsibility to read and understand these details before ordering or purchasing.

VENDOR’S TERMS OF USE

V-Bazaar is an online marketplace where vendors can sell vegan-friendly, cruelty-free and globally conscious goods, products, merchandise and supplies directly to likeminded customers worldwide. V-Bazaar aims to ensure that all vendors and their customers have a positive user experience on the platform. As such, vendors are advised to read the following terms, conditions, rights and expectations as detailed below.

Please be advised the below-listed comprises part of V-Bazaar’s Terms of Use. By using V-Bazaar as a retail platform for business purposes, the vendor is thereby agreeing to this policy and V-Bazaar’s overall Terms of Use.

1. What Products Can be Sold on V-Bazaar

V-Bazaar is the first online marketplace. It is designed to be the go-to place for all vegan-friendly, cruelty-free and globally conscious products. As such, all products listed for sale on V-Bazaar’s platform must fall into one of those aforementioned categories.

Vendors may wish to sell handmade items. If this is the case, the following conditions apply:

  • The vendor submits that any and all handmade products are made or designed by them. If the vendor works with a production partner, the vendor acknowledges that that fact must be disclosed where appropriate and/or applicable in product listings.
  • The vendor agrees to describe any and all personnel involved in the making of an item in the About section of their shop.
  • The vendor submits that they must use their own photographs when listing their handmade products. Stock photos, artistic renderings, or photos used by other Vendors or sites are not permitted.

If the vendor sells personalised or made-to-order handmade items, they agree to the following further conditions:

  • All products listed are available for purchase at a set price.
  • If the vendor uses photographs of products where customisation options (such as colour choices), the vendor agrees to clarify in the product description(s) that the photographs are just examples.

V-Bazaar encourages vendors to be transparent about how handmade products were made and where the materials used come from. Vendors should disclose if their products are organic or recycled.

2. What Products Can’t be Sold on V-Bazaar

While we aim to sell a wide range of products and services, vendors are advised that there are some products and services that cannot be sold on V-Bazaar. These will be products and services that violate V-Bazaar’s policies on Prohibited Items and Intellectual Property. The products may otherwise meet our marketplace criteria, but any products found in violation of those aforementioned policies and/or the below-detailed conditions are not permitted to be sold on V-Bazaar.

With handmade products, resale is not allowed on V-Bazaar. Resale in this case refers to listing a product as handmade when the vendor had no involvement in that product’s design or manufacture. In short, this classes as misrepresentation on the part of the vendor.

Vendors are advised that all V-Bazaar users are able to flag product listings that they believe are in violation of site policies. Any flags will be brought to V-Bazaar moderators’ attention to review. V-Bazaar reserves the right to remove any product listings that they find to be in violation of their policies. Vendors are advised that any listing fees incurred are non-refundable. V-Bazaar also reserves the right to suspend or terminate a vendor’s account for any violations. Vendors are advised that any outstanding fees existing on their V-Bazaar account will still require to be paid after termination or suspension. If the vendor is raising money on behalf of a charity, it is the vendor’s responsibility to gain that charity’s consent.

3. Vendor Self-Representation

V-Bazaar encourages a policy of transparency when it comes to vendors’ self-representation. This means that the vendor is to represent themselves, their products and business both honestly and accurately.

In selling products and services on V-Bazaar, the vendor agrees to the following:

  • The vendor will provide honest and accurate information in the About section of their shops on V-Bazaar.
  • The vendor will set down reasonable and acceptable shop policies and uphold them on V-Bazaar’s platform.
  • The vendor will represent their product listings in both text and photographic content in an honest and accurate manner.
  • The vendor submits to respect the intellectual property of other V-Bazaar users and third parties. The vendor acknowledges it is their responsibility to report any suspected violation of their own intellectual property rights to V-Bazaar.
  • The vendor agrees not to engage in any manner of fee avoidance.
  • The vendor agrees not to coordinate pricing with fellow vendors.

As such, they must exhibit full compliance with all relevant legal requirements. Including but not limited to applicable data protection and privacy laws, which govern the ways in which vendors can use V-Bazaar user information. In accordance with these laws, the vendor may be required to comply with their own business’ privacy policy. That policy should be publicly viewable on V-Bazaar, so that V-Bazaar users who visit the vendor’s business have access to this information. Vendors are advised that their business’ privacy policy must be compatible with V-Bazaar’s Terms of Use.

Vendors can build a reputation for their shop, products and services on V-Bazaar by encouraging its customers to leave product reviews. If no estimated date for delivery is shown on the customer’s account, customers will be able to post reviews after the product’s processing and/or shipping time has passed. Reviews can be edited by the customer within the 100-day period as many times as necessary – this also includes the photo.

The vendor is given the right to contact the customer if they receive an unfavourable review. In cases when the vendor receives a star rating of 3 or fewer stars, they are able to respond to the review.

Vendor responses to reviews follow the same conditions as the reviews themselves, in that they must adhere to the following:

  • The content cannot contain personal, private or confidential information.
  • The content must not consist of language or imagery that is considered obscene, racist, or can be construed as harassment.
  • The content must not contain any threatening or extortive language.
  • The content must not in any way be in violation of V-Bazaar’s Anti-Discrimination Policy.
  • The content must not contain any unsolicited advertising or promotional material.
  • The review must not contain any spam content.
  • The review must not relate to matters outside of the vendor’s control or responsibility, e.g. matters relating to the shipping carrier or courier, V-Bazaar itself, or a third party.
  • The review must not contain content that will falsely increase a vendor’s overall score.

7. Providing Great Customer Service

V-Bazaar has an expectation of a high level of customer service from the vendors using its platform. Vendors submit that they have a responsibility towards providing great customer service and a duty of trust with their customers.  By selling on V-Bazaar, the vendor agrees to:

  • Honour their shipping and processing timescales. Vendors are obligated to ship a product or otherwise complete a transaction with a customer promptly, subject to exceptional or extenuating circumstances. Vendors are advised that legal requirements for shipping times vary by country. V-Bazaar’s Shipping Policy has more information on this subject.
  • Respond to any communication from a customer or fellow vendor in a timely manner.
  • Honour their own business and shop policies.
  • Resolve any and all disputes or issues directly with the customer. In the event that a resolution cannot be reached, our Dispute Resolution team can help through our case system.
  • Notify the customer if an order cannot be completed. It also falls to the vendor to cancel that order.

8. Responding to Requests for Cancellations, Returns, and Exchanges

Vendors are advised that, in addition to the policy herein detailed, laws relating to shipping, cancellations, returns and exchanges differ from country to country. Vendors should familiarise themselves with the relevant laws of their own country and those of their customers.

Cancellations

In the event that a vendor cannot complete a transaction, the vendor must notify the customer via V-Bazaar’s communication tool and cancel the transaction. If the customer has already submitted payment, it is the vendor’s responsibility to issue a full refund. Vendors are encouraged and advised to keep proof of any refunds issued in the event of a dispute arising. Vendors and customers are advised that any and all cancellations are subject to V-Bazaar’s Cancellation Policy.

European Union Right of Withdrawal

Customers in the European Union (EU) may be entitled to a 14-day “right of withdrawal” after receipt of a product, during which they may return that product for any reason. The details of this right vary depending on the EU member state. All users are advised that The Right of Withdrawal does not apply to custom products or certain perishable goods.

V-Bazaar’s System

V-Bazaar encourages customers to contact a vendor directly first in order to resolve any outstanding issues. If a resolution cannot be reached, the matter can be brought to V-Bazaar for entry into its system. With this in mind, vendors are advised to acknowledge the importance of making their shop policies publicly accessible and are encouraged to regularly and promptly respond to any customer communications.

Customers uphold the right to file a case with V-Bazaar’s system for a product that has not been delivered or is not as described on the vendor’s product listing. The vendor is obligated to respond to any open cases within seven days or the timescale noted by V-Bazaar’s system. V-Bazaar reserves the right to escalate a case early in the event of circumstances such as vendor inactivity, harassment, refusal of service or case manipulation.

By using V-Bazaar’s system, the vendor submits the understanding that V-Bazaar may use their personal information to aid in resolving any disputes with other site users. Cases can be filed to the system under the following circumstances:

Non-Delivery

When a dispute is ineligible for our case system, V-Bazaar encourages both parties to work together to come to an amicable solution.

V-Bazaar’s Anti-Discrimination Policy

V-Bazaar takes a strong stance against discrimination of any kind. Our aim is to build and protect a better world and connect likeminded people of all backgrounds in an environment that promotes cruelty-free and globally conscious ideals. To ensure that all customers and vendors consider V-Bazaar to be a safe environment, we have set down a detailed anti-discrimination policy as below.

Please be advised that by using V-Bazaar, the user is agreeing to adhere to the following anti-discrimination policy, which forms part of our Terms of Use.

On V-Bazaar, any discrimination based on the following is expressly prohibited:

  • Colour, Race or Ethnicity
  • Gender, Self-Identity or Sexual Orientation
  • Disability – both physical and mental
  • Religion
  • All other characteristics protected under applicable UK law

Please be advised that it is the customer’s / vendor’s own responsibility to be aware of their regional and national laws and regulations pertaining to discrimination.

As a customer on V-Bazaar, any of the following discriminatory behaviour is prohibited on this site:

  • Refusal of service toward any of the above-listed protected groups
  • Derogatory or offensive remarks toward any of the above-listed protected groups
  • Racial or ethnic slurs
  • Comments, remarks or posts that promote, glorify or show support of hate groups and members thereof

If the user believes the user have seen or read something discriminatory on V-Bazaar, we encourage the user to contact us on [email protected] If the user believes a listed item is in violation of our Prohibited Items Policy, the user can report it via the Report link at the bottom of the item’s page. Please be advised that reviews of all reported discrimination are dealt with in a timely manner.
